A significant change for recent foreign graduates in the Netherlands

During the validity of this permit, the foreign graduates can look for a job in The Netherlands and apply for a residence permit

Foreigners who graduate in the Netherlands,
as well as foreigners who have recently graduated at certain international institutions, can apply for a Dutch residence permit for an “orientation year highly educated persons”.  

During the validity of this permit (1 year), the foreign graduates can look for a job in The Netherlands and apply for a residence permit as a highly-skilled migrant. In order to qualify for the highly skilled migrant residence permit for these recent graduates, a reduced salary threshold applies (for 2020 this is € 2,423 gross per month).

Because of the corona pandemic, it is currently challenging for these recent graduates to find a qualifying job.

Last week the Dutch Immigration Department stated that it understands the corona crisis has a massive impact on the opportunities for international students to find a job as highly skilled migrants in The Netherlands. It has therefore decided that the reduced salary threshold may also be invoked after the 1-year residence permit for an orientation year has expired, provided that the graduate finds a job as a highly-skilled migrant (from abroad) within 3 years after graduation.

The need to repurpose and upgrade the skills of the workforce is accelerating with the onset of the pandemic. The high dependence on technology means that employees must be trained to work properly and effectively. Moreover, as the size of teams shrinks due to the financial constraints of organizations, a project-based collaboration culture will become more prevalent. In this way, a new culture of lifelong learning and training will be reinforced.

Even if you are a digital carrier, it is imperative to set your goals to improve digital fluency among the workforce. The Equality and Human Rights Commission (EHRC) has launched an investigation into the Home Office’s UK visa and immigration policy. An investigation by a human rights agency will determine whether the Home Office’s immigration measures violate equality laws.

The controversial measures have resulted in disastrous consequences for thousands of Windrush generation legally residing in the UK. The EHRC said it will use its legal authority to assess whether the Home Office is complying with its public sector equality responsibilities, as part of a commitment to ending “systemic and entrenched race inequalities that exist in the UK.”

Typically, the EHRC checks whether the Home Office has considered the potential impact of its hostile immigration measures on the Windrush generation, especially as legal charities have warned that many of the Windrush community are undocumented and could be seriously impacted because of the new policies.

Following the launching of the Home Office’s hostile environment, when former UK Prime Minister Theresa May was Home Secretary, thousands of people who arrived in the UK under perfectly legal circumstances in the 1950s and 1960s were mistakenly classified as illegal residents, in compliance with the rules is not meant for them.

Therefore, many of the UK’s legal residents were left devastated, many lost their homes and jobs, while many were denied access to medical care. In extreme cases, some were detained and then forced to leave the UK.
