Implications of Temporary Bridging Measure for Sustained Employment

Make sure that the salaries of your Knowledge Migrants and Blue card holders do not drop below the applicable salary thresholds

The corona-crisis may bring the need for your company to use the Temporary Bridging Measure for Sustained Employment (Tijdelijke Maatregel Overbrugging voor Werkbehoud: NOW).

Please be aware of the fact that the IND has published on its website that you, as employer, are obliged to report the use of this measure for your foreign non-EU/EER employees to the IND within 4 weeks.

However, it is important to realize that the IND also mentions on their website that it did not take an official position yet on the question if the use of the NOW for your foreign employee will affect the validity of the residence permit your employee.

In this respect, please realize that the validity of the residence permits of your non-EU/EER foreign staff may depend on the salary amount you are paying to this foreign employee on a monthly basis. For example if this foreigner is in possession of a residence permit as a Highly Skilled Migrant or a Blue Card.

Since in regular circumstances the IND generally withdraws a residence permit if the applicable salary of your non-EU/EER foreign employee drops below the applicable salary threshold, and the IND did not publish an official position on the above yet, all EMG can do at this moment is advise you to make sure that, if you need to use the NOW or take other measures to secure your cash flow position, the monthly paid out salaries of your Knowledge Migrants and Blue card holders do not drop below the applicable salary thresholds.
