Spanish Ruling Restricts Ability of Residents Subject to Expatriate Regime to Claim US Deduction for Taxes Paid in Spain

The General Directorate of Taxes has recently released a ruling that denies Spanish residents, who are subject to the Expatriates Regime, the option to claim a tax deduction for payments made in Spain when filing taxes in the United States, as per the regulations outlined in the tax treaty and domestic legislation.

The ruling pertains to an individual seeking to benefit from the special tax regime applicable to employees stationed in Spain, known as the Expatriates Regime. The applicant in question possessed a Green Card, which is a permanent resident card issued by the United States.

According to the tax authorities, if an individual falls under the Expatriates Regime and is subject to taxation, they will not be considered a resident of Spain for the purposes of the Spain-United States Income Tax Treaty (1990) (as amended through 2013). Consequently, if the United States imposes taxes on the applicant, the tax paid by the individual in Spain cannot be claimed as a deduction under the tax treaty and domestic legislation that aims to prevent international double taxation. In such a scenario, it is the responsibility of the United States to eliminate the possibility of double taxation.

The ruling, identified as V0698-23, was officially issued on March 23, 2023, and its recent publication took place on May 11, 2023.
